Arbitration

Any controversy or claim arising out of or relating to this Agreement or any breach thereof shall be settled by arbitration in front of a single arbitrator in Pasco County, Florida. in accordance with the Commerical Arbitration Rules of the American Arbitration Association; and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The determination of the arbitrator in such proceeding shall be final, binding and non-appealable. Each party
retains the right to seek judicial assistance: (i) to compel arbitration; (ii) to obtain interim measures of protection prior to or pending arbitration; (iii) to seek injunctive relief in the courts of any jurisdiction as may be necessary and appropriate to protect the unauthorized disclosure of its proprietary or confidential information; and (iv) to enforce any decision of the arbitrator, including the final award. Each party agrees that any permitted judicial assistance arising out of or relating to this Agreement may be brought and prosecuted only in the United States District Court for the North-Western District of Florida, and by execution of this Agreement via purchase each party hereto submits to the exclusive jurisdiction of such courts and waives any objection it might have based upon improper venue or inconvenient forum. The arbitration proceedings contemplated by this Agreement shall be as confidential and private as permitted by law

Coupon Codes

From time to time, JJ Snowglobes, LLC offers different coupon codes in media and online. Please note, we only can accept 1 coupon code per order. Multiple users per order are not accepted. If used, we will honor the highest code presented and the other codes if used, will be invalid. We will apply the proper charge back to the payment method on file. Specific priced jobs are not subject to coupon codes as the price is discounted during the proposal.

Credit Cards and Paypal

We accept the following credit cards: Visa, MasterCard, American Express and Discover. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card statement will reflect the name “JJ snowglobes, LLC”. We also accept PayPal. Duty Fees / Tariffs

Certain Countries have added fees known as duty, tariff or other type importing fee on all items being brought in. All possible fees are the responsibility of the receiver of items.

Governing Law

By placing your order with JJ Snow Globes, LLC of Florida via the internet or over the phone, you agree that all questions concerning the validity, interpretation, or performance of any of its terms, provisions, or any rights or obligations of the parties here so shall be governed by and resolved in accordance with the laws of the State of Florida in the County of Pasco.

Products Limitation of Liability

Except for personal injury, JJ Snow Globes, LLC, total liability whether for breach of contract, warranty, late delivery or non-delivery, negligence, strict liability in tort or otherwise, is limited to the price of the particular product(s) sold with respect to which losses or damages are claimed. JJ Snow Globes, LLC, will not be liable for any incidental, special, or consequential damages, to the full extent such may be disclaimed by law. Some States do allow the exclusion or limitations of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

Order Acceptance Policy

Your receipt of an electronic or another form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. JJ Snowglobes, LLC reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

Order charges - Changes

We will process your order, as you specify, from the order form or email. Sometimes, we will need to contact you prior to beginning a project and specify if an additional charge will be necessary to complete the doll as you specified.

EX. You order a custom bobblehead doll and in the notes ask for that doll to be sitting in a desk with a computer and phone on it. The desk, chair, computer, and phone are not included in a custom bobblehead doll price listed. We would need to charge an additional amount to make it as specified.

Change orders – once we receive your order and begin production, changes from the original order are subject to additional charges. Meaning, if you send us a photo with a person wearing sunglasses, we will create what we see. Once the proof is received, if you require the removal of glasses, an additional charge would apply. This applies to body, clothing, colors as well. As all our work is custom designed, we cannot simply remove clothing, or change a baked-on color.

Our success rate with our customer is near perfect. We are proud of this and base it on our ability to communicate with our clients as well as draw feedback from them as we sculpt each step.

Other Conditions

These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether JJ snowglobes, LLC signs them or not. We reserve the right to make changes to this site and these Conditions at any time.

Photo type and Hair Facts

Photo Types

We accept the following photo types on our online order form.

Jpg, BMP, png, AI
PS, PDF, Gif

Per order, we require at least 1 head photo in the expression of the person we are creating. We use 1 photo per head only and can not combine features between multiple photos.

Body photos are not required but we do best when we sculpt from what we can see. Description will work as well.

Hair Styles and bobblehead dolls.

We fall back to the primary photo in regards to the hairstyle. We recommend for some folks who wear their hair a certain way in the back to provide a rear or profile photo so we can see the type of hair they are referring to.

Important note, our bobblehead dolls are created with resin which is very hard by nature. Due to the construction of our dolls, the hairline must not interfere with the shoulders or neck. We will do our best to make the hair on the doll low enough to allow a bobble action. If the hair is lower than the shoulders, the movement will be restricted. Requests to make the hair in the front and back below the shoulder; is fine but your doll will have limited or no movement within the head. For this type of doll, we recommend our clients to order a fixed head type where we have no limitations. If you provide a photo with long hair, we will do our best to make the hair like the photo and provide as much movements as possible. But we do urge you to only create the hair above the shoulder to allow our bobblehead dolls the maximum bobble action.

Proofing Policy

We believe proofs are a wonderful way to help ensure a super experience. We provide free proofs on our bobblehead dolls. However, we must point out, faster orders that are 1-2 weeks or less will allow for internal proofing only. We would make and send the doll with no proofs to the client.

What are proofs? Proofs allow you to become part of the creation process. We provide clay proofs for each head and body and after those are approved, we will provide color painted proofs as well. Proof photos are sent to your email and require a written approval or denial.

IMPORTANT FACTS ABOUT PROOFS

1. Orders that are 1-2 or 1 week will not receive any proofs. We use internal proofing due to the delivery time line.
2. Clay proofs are provided for the head and for the body. During each phase of proofing, we can make changes based on the original order and written feedback. Once the clay is approved, we will bake it and no further structure changes are possible.
3. Once a clay head or body is approved, if a new sculpt is required, a fee of 55.00 per item would be imposed.
4. If you order your head with glasses or a hat, and it is not seen when we provide you the clay head proofs – do not approve it. If you approve it without the hat or glasses, it will not be possible to add it afterwards.
5. Clay proofs do not represent any true color. Sometimes we use different clay which will not appear once completed.
6. Color Proofs are given once the clay has been approved. The color proofs will reflect all the necessary items to be on the doll at this time. If you approve the color proof and something is missed, it cannot be added after.
7. Once color proofs are approved, we prep for final shipment. We send our items FEDEX or DHL in most cases. We use overnight services that require a signature.

We like to be upfront with our clients. Being human, we realize that we all envision things as we hope they will be. We have been making custom bobble head dolls since 2004 and over the years we have had a few clients we just could not appease. Once a completed proof arrives via email, if you are not fully satisfied, we suggest the following steps.

• Try to modify the paint. Adjust the complexion. Colors can play a big part in approval.
• Resculpt the head- this imposes a 55.00 fee. We also recommend a new photo to sculpt from.
• Resculpt the body – this will impose the 55.00 fee.
• If no option satisfies our client, we will consider the order complete. Due to the nature of fully custom work, we cannot re-sale this item to another person, and we will simply send the bobble head doll/s to you.
• Refusal of a mailed item: In the event the job defaults to become complete and we send the item. Our clients have the right to refuse delivery and turn it back to the sender. If this happens, we will receive the doll back, but it does not cancel the terms of the order set forth during the checkout. If an order is returned to us, we will hold it for 30 days. We can resend the order to the client with a written request – a shipping fee will be added before shipment over the listed order as we already spent the shipping money on the first attempt. Please note shipping companies also have the policies in place to destroy deliveries that are not accepted. In the event you refuse an order, and this occurs, we would not be able to send you another item. You would be required to reorder a new doll. All our dolls are shipped with signature.

If you would like us to return the photo back to you-you will need to supply us a self-addressed, stamped envelope. Any photos received without one will be discarded after we scan them into our computer system. We bear no responsibility for lost photos in the mail.

Shipping and Damage Claims

If your doll/s are received with damage to it, please follow our directions listed here:

As we try to avoid damages with extreme care within our packing, sometimes damage can occur.
All claims for any damage to our products must be filed by the recipient to JJ Snowglobes, LLC in writing within (3) three days of receipt, including sending digital photographs of the damaged product, box and packing material to us at sales@jjsnowglobes.com

Due to the nature of our business and the storage of existing molds, we won’t be liable for any damages which have not been reported within the 3 business days (including photos).

Once we receive the written notification, we will notify you of our acceptance and provide the next steps based on the following information:

Complete Damage to the product – we will recast you a copy from the existing mold used. We will provide photo proof of the completed doll and resend it to you in the mail.
Slight damage to the product – we will determine if the damage is easily repaired (recommend crazy glue) prior to replacement. If the damage is small, we may ask you to send it to our facility for repair at our sole desecration.
Under no circumstance will a refund be offered for any situation in regard to your custom made bobblehead doll. As per our checkout policy, which was agreed to, we offer no such refunds.

All our merchandise is carefully packaged for shipment in an approved box along with various form of packing material. JJ Snowglobes, LLC may ask for the return of the original damaged doll you received to be sent back to us. If this is requested, it is our client’s responsibility to send it in the same packaging via USPS priority mail with tracking information. Once we have received the item, a replacement will be sent to you.

Please note, sometimes we need to ship the doll in 2 pieces to assist in the safety of proper delivery.

Bulk Orders Damage Policy

As damages sometimes cannot be avoided, we always try to make the transition of replacement as easy as possible. As we use third parties for shipping and delivery, it may be necessary to file an insurance claim if damaged items are received.

JJ Snowglobes, LLC will handle the claim and all aspects of replacement, but we will require our client to provide information that may become necessary to satisfy the insurance company.

If you receive damaged shipping, you must notify us in writing within 3 days of receipt of your items

We require photos of the damaged items. When presenting photos, make sure you provide all the damages to master cartons, pallets, product packaging, and actual pieces.

It is necessary to provide photos of all the damaged items to use as proof per the insurance companies’ requirements. We recommend providing the photos when the claim is written.

In the event the insurance company requires an additional request, photos or information necessary to assist them in investigating and making the approval of the claim, the recipient agrees to provide it within 48 business hours.

Failure to comply can result in the claim being denied by the insurance company. In the event this occurs, you agree to hold harmless and indemnify JJ Snowglobes, LLC, all employees, agents, and third-party vendors.

Some Assembly Required

As all our dolls are created by hand, they sometimes need to be shipped and packed into styrofoam or into different packing material such as this:

The main doll is wrapped in various bubble wrap and foam, placed into a secure setting within the main box. Sometimes, different parts of the doll are needed to be shipped separate from the main doll and like the base listed below, the use of crazy glue works best for assembly. We feel it is better to have every effort to allow your dolls to arrive safely than damaged.

The base may be separated from the doll, wrapped along the same lines and placed into its own created spot within the Styrofoam.

To assemble, we recommend "crazy glue" which works best.

As we try very hard to prevent any troubles on receipt, please understand we pack them as they need to be packed to help assure this.

Taxes

JJ Snowglobes, LLC shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the state of Florida. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, JJ snowglobes, LLC shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. JJ snowglobes, LLC shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, JJ Snowglobes, LLC shall immediately issue a credit to your credit card account in the amount of the incorrect price.

Reversals (credit) appear within 3 - 5 business days.

Use of images

JJ Snowglobes, LLC reserves the right to send images of the custom bobblehead dolls or other products to the email address provided by the customer at the time of ordering. These images may be superimposed on various background scenes. Any forwarding or sending of these images to others beyond the party ordering the product - whether authorized or unauthorized, in electronic or physical form is not the responsibility of JJ Snowglobes, LLC.

JJ Snowglobes, LLC will from time to time use your doll photos in any public forum, including on our website ("fullcustombobblehead.com") or in promotional offerings. If you opt to not be used, please let us know and we will refrain from doing so.
